The National Agency for the Prevention of Corruption (NACP) drew up a protocol on administrative offenses against the deputy head of the Office of the President of Ukraine (OPU) Rostyslav Shurma due to violation of requirements for the prevention and settlement of conflicts of interest. Information about this is posted on the NAZK website.
The case concerns issues with payments to power plants that generate energy from alternative sources, while the final beneficiary is the official's brother, Oleg Shurma.
According to the NAZK, in 2022, Rostislav Shurma organized the Electric Power Committee at the OPU, the members of which met under his leadership. Key institutions related to the electric power industry participated in the meetings of the Committee: the Ministry of Energy, the National Commission for State Regulation in the Field of Energy and Communal Services (NKREKP), PJSC NEC Ukrenergo, SE Market Operator, SE Garantovany buyer".
Rostislav Shurma's brother, Oleg, is the ultimate beneficial owner of seven companies that generate electricity from alternative sources. In the period from 2019 to 2021, Rostislav Shurma himself was a member of the supervisory board of JSC "Closed non-diversified venture corporate investment fund "Helios", which is a co-founder of three of the above companies.
As of July 2022, when the first meetings of the Committee were held under the leadership of Rostislav Shurma, the SE "Guaranteed Buyer" had a significant debt for electricity produced from alternative sources, purchased from Oleg Shurma's companies. The amount owed to the companies amounted to almost 254 million hryvnias.
According to the NAC, during the meetings of the Committee on August 23 and September 7, 2022, Rostislav Shurma encouraged PJSC "NEC "Ukrenergo" and SE "Guaranteed Buyer" to sign and approve at the NECRC acts of acceptance and transfer of services provided to ensure an increase in the share of electricity production from alternative sources for a certain period. Such actions affected the satisfaction of Rostislav Shurma's private interest, namely, they contributed to the success of his brother's business through the adoption of necessary decisions by state bodies and companies related to the electricity market.
Rostyslav Shurma, the deputy head of the Office of the President of Ukraine, participated in the meetings of the Committee without proper notification of the existing conflict of interests and discussed decisions related to his private interest in the specified area.
It was previously established that the solar stations, which are under Russian occupation and have a co-owner from Rostislav Shurma's entourage, were paid according to the "green tariff" until the summer of 2023. According to data from July 2022 to July 2023, these companies received more than UAH 320 million in payments for electricity from the state enterprise "Guaranteed Buyer".
The National Agency for the Prevention of Corruption drew up a report on Rostislav Shurma's violation of the requirements for the prevention and settlement of conflicts of interest, which was sent to the court under Article 172-7 of the Code of Ukraine on Administrative Offenses. If found guilty, the court may impose a fine on him, and the official's data will be entered into the Unified State Register of persons who have committed corruption or corruption-related offenses.
