New mobilization rules: which of the educators and students can get a deferral

The Verkhovna Rada of Ukraine amended the legislation on mobilization, clarifying which of the graduate students, students and teachers is entitled to defer from military service. The amendments were adopted in April 2024 and provides for new conditions for representatives of the educational sphere.

According to the current rules, graduate students can get a deferral, but this does not free them from mobilization in the future. The right to a deferral have:

  • students of higher education institutions up to 30 years;
  • persons with scientific titles;
  • full -time teachers;
  • pedagogical staff of professional advanced educational institutions;
  • Interns that study on full -time form.

However, there is an important clarification: entering the university to obtain a second or third higher education does not entitle the deferral. This prevents cases where citizens try to avoid mobilization by repeated entry into educational institutions.

What will change in 2025?

From next year, only graduate students who study in a budget form will have the right to defer. The contractors will remain only a correspondence training that does not entitle the deferral.

These changes are not yet final, but the likelihood of their adoption is high.

What documents are needed to get a deferral?

To confirm the right to a deferral, you must provide:

  • passport of a citizen of Ukraine;
  • identification code;
  • military accounting document (military ticket or temporary certificate);
  • certificate from the educational institution (form №20);
  • summons (if it was issued).

After that, the conscript must undergo a Military Medical Commission (VLK) and get an official deferral decision.

When is the delay not valid?

There are cases where graduate students can be mobilized early:

  • at will;
  • if they study in military specialties or in national security areas;
  • during the annual operational departures of mobilized.

New changes in mobilization legislation continue to be discussed, as they have a significant impact on students and educators. The final rules will be known after their full approval.
