From January 1, 2025, new regulations will enter into force in Ukraine, regulating the imposition of fines on drivers for not having a mandatory auto insurance policy (autocivilka). Law 3720-IX "On Mandatory Civil Liability Insurance of Owners of Land Vehicles" stipulates that the verification of the existence of an insurance policy will be carried out not only during a traffic stop by the police, but also automatically with the help of auto-fixation cameras.
The cameras, which already have a lot of experience in fining drivers for violating traffic rules, will now have an additional function - to detect the lack of insurance. According to the new law, a fine of UAH 425 will be imposed on the legal owner of the car, and not on the driver who was driving the vehicle at the time of the violation.
Such a rule raises certain legal questions, as it contradicts Article 61 of the Constitution of Ukraine, which emphasizes the individual responsibility of individuals. Currently, the issue of compliance of this norm with the Constitution is under consideration in the Constitutional Court, but the decision has not yet been made.
For drivers, this means that they should be especially careful about the presence of a civil liability policy, because fines for not having it can be imposed without their direct contact with the police, but only through the auto-fixing system.
