An assistant to a Kyiv notary will be tried for illegally certifying over 1,500 documents on behalf of her manager, who has been abroad since 2022. According to the investigation, she performed notarial actions without proper authorization, using access to official forms, a seal, a notary's digital signature, and notarial registers of the Ministry of Justice of Ukraine.
According to the Kyiv City Prosecutor's Office, the assistant is accused of entering false data into notarial registers, which is a violation of Part 5 of Article 361 and Part 3 of Article 358 of the Criminal Code of Ukraine. Her actions are punishable by up to 15 years in prison, as well as a ban on holding certain positions for up to three years.
The investigation established that a notary working in the Kyiv City Notary District had been abroad since February 2022 and had instructed his assistant to perform notarial acts. She had access to all documents and registers necessary for certification, which allowed her to perform more than 1,500 notarial acts without authorization.
Despite the fact that the clients did not suspect the documents were falsified, the investigation established that all these actions were illegal. Now the case has been transferred to the court, where the further measure of responsibility of the assistant will be determined, as well as the issue of the notary herself, who is abroad and is already the subject of separate criminal proceedings.
