Fine for evasion abroad: what threatens violators of military registration

According to Ukrainian law, men of military age are required to keep military records, even when abroad. Violation of this obligation is punishable by a fine of 17,000 to 25,000 hryvnias. However, what to do if you receive a fine from the territorial recruitment center (TCK) and cannot pay it?

Lawyer Dmytro Franchuk spoke to RBC-Ukraine about the consequences of not paying the fine and the possibility of appealing it.

Consequences of failure to pay a fine

  • Penalty Charge: For each day of delay, a penalty is added to the fine amount.
  • Enforcement: The CCC may apply to the enforcement service to collect a fine through the seizure of property in Ukraine.
  • Entry restrictions: Data on non-payment may be transmitted to the border service, which may result in a ban on entry into Ukraine.

The fine is a personal liability and cannot be transferred to relatives. However, if the seizure is imposed on joint property, it may affect the interests of the co-owners.

How to appeal a fine abroad

Appealing a fine for those outside of Ukraine is a complicated but possible process.

Steps to appeal:

  1. Drawing up a power of attorney:
    • Notarize the power of attorney at the consulate of Ukraine or apostillize the document (for countries that are parties to the Hague Convention).
    • A power of attorney will allow your representative in Ukraine to act on your behalf.
  2. Submitting an application to the CCC:
    • The representative must file an appeal with the CCC, indicating:
      • Personal data of the person who was fined.
      • Details of the resolution.
      • Reasons why the fine is considered illegal and evidence of this (e.g. documents proving your stay abroad).
  3. Appeal in court:
    • If the CCC refuses to grant the application, file a lawsuit in court.
    • A representative by power of attorney may file a lawsuit. The deadline for filing is 10 days from the date of receipt of the CCC decision.

Lawyer's advice

Dmytro Franchuk emphasizes that avoiding cooperation with the CCC can lead to more serious consequences, including criminal liability for evading mobilization. If you receive a summons, it is important to immediately contact a lawyer and begin procedures to resolve the situation.
