The pension provision of prosecutors in Ukraine is regulated by special legislation, which determines the right to receive pensions for years of service, disability, as well as pensions in connection with the loss of a breadwinner for their family members. The main legal act regulating these issues is Law of Ukraine No. 1697.
This is stated in the materials of the PFU.
Law 1697 provides for the right to award seniority and disability pensions to prosecutors, and bereavement pensions to their family members.
Pension for years of service
Prosecutors have the right to pension for years of service, regardless of age, provided that, on the date of application, the following years of service are at least:
- by September 30, 2011 - 20 years, including at least 10 years of work experience as a prosecutor;
- from October 1, 2011 to September 30, 2012 - 20 years and 6 months, including at least 10 years and 6 months of work experience as a prosecutor;
- from October 1, 2012 to September 30, 2013 - 21 years, including at least 11 years of experience as a prosecutor;
- from October 1, 2013 to September 30, 2014 – 21 years and 6 months, including at least 11 years and 6 months of work experience as a prosecutor;
- from October 1, 2014 to September 30, 2015 - 22 years, including at least 12 years of experience in the positions of prosecutors;
- from October 1, 2015 to September 30, 2016 – 22 years and 6 months, including at least 12 years and 6 months of work experience as a prosecutor;
- from October 1, 2016 to September 30, 2017 - 23 years, including at least 13 years of work experience as a prosecutor;
- From October 1, 2017 to September 30, 2018 – 23 years and 6 months, including at least 13 years and 6 months of work experience as a prosecutor;
- from October 1, 2018 to September 30, 2019 - 24 years, including at least 14 years of experience in the positions of prosecutors;
- from October 1, 2019 to September 30, 2020 - 24 years and 6 months, including at least 14 years and 6 months of work experience as a prosecutor;
- from October 1, 2020 and later - 25 years, including at least 15 years of experience as a prosecutor.
Prosecutors are granted a pension in the amount of 60 percent of their monthly (current) salary, which includes all types of wages, from which a single contribution to the mandatory state social insurance was paid, and until January 1, 2011 - insurance contributions to the general Compulsory state pension insurance, received before the month of applying for a pension.
The amount of payments (except official salaries, seniority allowances) included in earnings for pension calculation is determined at the option of the person who applied for a pension, for any 60 calendar months of such work in a row before applying for a pension, regardless of the presence of breaks during of this period at this work.
The average monthly amount of the specified payments for 60 calendar months is determined by dividing the total amount of such payments by 60. The adjustment of the specified payments is carried out using the coefficient of the general increase in the size of the official salary and its allowances. Salary, allowances for years of service are taken into account during the appointment of a pension in the amounts for the last held position of the prosecutor, established at the time of the right to recalculate the pension for years of service.
Employees who do not have the years of service provided for above, in the presence of the necessary length of work in the positions of prosecutors, as well as the insurance length of service necessary for the appointment of an old-age pension in the minimum amount, provided for in the first paragraph of the first part of Article 28 of the Law of Ukraine "On Mandatory State Pension insurance", after reaching the age of 57 for men, and for women five years less than the retirement age, established by Article 26 of the Law of Ukraine "On Mandatory State Pension Insurance", a pension is awarded in an amount proportional to the number of full years of work in prosecutor's positions, at the rate of 60 percent of the monthly salary for the relevant length of service.
The years of service, which gives the right to a pension for years of service, include the time of work in the positions of prosecutors specified in Article 15 of the Law of 1697:
- interns, in the positions of assistants and senior assistants of prosecutors;
- investigators, judges;
- in the positions of the senior staff of internal affairs bodies, tax police, criminal enforcement service, officers of the Armed Forces of Ukraine, the Security Service of Ukraine, other military formations formed in accordance with the legislation of Ukraine, in the positions of civil servants held by persons with a higher legal education;
- in scientific and educational institutions of the General Prosecutor's Office of Ukraine to employees who were assigned class ranks before the entry into force of this law (employees of the military prosecutor's office - corresponding military ranks), including the time of scientific and teaching work in other scientific and educational institutions, if they had a scientific degree or an academic title;
- in administrative and teaching positions, positions of scientific workers in the National Academy of the Prosecutor's Office of Ukraine;
- in elected positions in state bodies, in positions in other organizations, if employees who were assigned class ranks before the entry into force of this Law (employees of the military prosecutor's office - corresponding military ranks) were sent there, and then returned to the prosecutor's office;
- military service, half the term of study at full-time higher legal educational institutions or at law faculties of full-time higher educational institutions;
- parental leave until the child reaches the age of three, if such leave was granted.
Persons who, immediately before applying for such a pension, work in the prosecutor's office or in scientific and educational institutions of the General Prosecutor's Office of Ukraine, as well as persons dismissed from the prosecutorial positions of the prosecutor's office due to their health, have the right to a long-service pension. in connection with the liquidation or reorganization of the prosecutor's office in which the person holds a position, or in connection with a reduction in the number of prosecutors, in connection with their election to elected positions in state authorities or local self-government bodies. War veterans who have the necessary length of service to be granted a retirement pension are granted such a pension, regardless of whether they worked in the prosecutor's office before applying for a pension.
Disability pension
Prosecutors recognized as persons with disabilities of group I or II are granted a disability pension if they have at least 10 years of experience in the prosecutor's office.
As a reminder, during May and June, some pensioners may receive pension supplements. This is foreseen by a special program from the UN, which has been in effect in Ukraine since August 2023.
