The court changed the measure of restraint with a 16-year-old boy who is suspected of beating a girl in the White Church of the Kiev region. Despite the fact that the judges considered it necessary to keep him in custody, he was now released under his or her personal obligation. This means that he should appear to the investigator but has no restrictions on movement.
The lawyer of the victim girl Masya Nayem informed about it, expressing indignation with such a decision.
Recently, the Court of Appeal has confirmed the need to keep the suspect in custody, arguing that such a preventive measure guarantees his presence in court and protects the victim. However, the court's position has changed now, and the boy was released without any real restriction of freedom.
The lawyer believes that although house arrest would be a more balanced solution that limits freedom of movement but does not violate fundamental rights, the court decided otherwise.
It is unknown whether the prosecutor's office will be appealed, but Nayem expressed his hope that the decision would be revised.
"Not only the process, but also the safety of all participants should be protected," the lawyer emphasized.
The case has already caused resonance in society, because the court's decision actually allows the suspect to be at large without significant restrictions, despite the seriousness of the crime, which he threatens up to 12 years in prison.
