The next meeting was held in the premises of the Odessa Commercial Court, dedicated to the consideration of the lawsuit filed by the military prosecutor's office against "Basco" LLC. The essence of the lawsuit is to get the property complex of the company located in Odesa, which was sold by the Ministry of Defense twenty years ago.
The participants of the meeting from the prosecutor's office and the Ministry of Defense tried to convince the court of the illegality of the agreement on the sale of property. However, their arguments turned out to be less convincing compared to the arguments of representatives of the "Basco" bar association.
Most of the meeting was devoted to discussing the legitimacy of the power of attorney, on the basis of which the object was sold. This became another confirmation that the position of the prosecutor's office and the Ministry of Defense in this case has significant flaws.
The plaintiff again emphasized that the head of the Central Department of the Ministry of Defense had no right to issue a permit for the sale of the object. However, the defendant's lawyers confirmed that the notarial power of attorney can be revoked only through a notary, which did not happen within the specified time.
All accusations against "Basco" were divided into confirmed facts and arguments of lawyers, who documented the legality of the purchase and sale agreement. The statements of the prosecutor's office about the illegal resale of the property complex were not confirmed in the evidence presented at the meeting.
Overall, the court hearing confirmed that the prosecution's attempts to reopen this case without any new evidence or arguments seem strange. Judge Guth set the next hearing for March 7.
