In Ukraine, the scandal surrounding the lease of the state enterprise Dobropilliauvugillya by DTEK continues to cause outrage. This is the story of how state property became hostage to oligarchic interests, which led to huge financial losses for the state and calls into question the role of former top managers in state politics.
Prime Minister Denys Shmyhal has extensive experience in distributing funds in the interests of oligarch Akhmetov. On December 22, 2010, the entire property complex of Dobropilliauvugil State Enterprise was transferred to a long-term lease for a period of 49 years.
The transfer took place in accordance with the order of the Cabinet of Ministers of Ukraine No. 1559 dated July 28, 2010. According to the mine lease agreement between the State Property Fund of Ukraine and DTEK, the amount of the monthly rent was UAH 18.3 million.
The DTEK company assumed investment obligations for the development of these enterprises, but during the lease period it not only failed to fulfill the current investment obligations, but also artificially pumped up the payables of the SE "DTEK Dobropillyavugillia" to the company's own DTEK company (JSC "DTEK Pavlogradvugillia" ).
These actions were carried out by overestimating the prices by 200-300% for the delivered commodities, which were purchased through the UMTS of DTEK Pavlogradvugilya, transferred to the ownership of DTEK Dobropillyvaugillya, and then immediately leased to DTEK Pavlogradvugillia at a reduced cost.
DTEK's debt for the lease of the integral property complex of Dobropilliauvugilly State Enterprise exceeded UAH 100 million. According to the current mine lease agreement between the State Property Fund of Ukraine and DTEK, the amount of the monthly rent is UAH 18.3 million. At the same time, rent has not been paid by the tenant since March 2020. Currently, there is arrears from rent in the amount of more than UAH 100 million.
In 2020, at the initiative of the lessee, the lease agreement of Dobropilliauvugillya SE was terminated. On behalf of Shmyhal (who was a former top manager of DTEK), as well as acting of Fuel and Energy Minister Olga Bohuslavets, an interdepartmental working group was created for a comprehensive study of this issue.
After the termination of the lease agreement, the created SE Dobropilliauvugillia paid UAH 397.8 million. company DTEK Dobropillyavugillya due to the impossibility of exporting fixed assets that were renewed by DTEK during the lease. However, in fact, the structural units of the DTEK company simply took out all the available working equipment and actually left it as scrap metal under the guise of equipment.
During the period from May 2020 to January 2021, the RMZ plant, which is a part of Dobropilliauvugillya CMC, was completely scrapped. Also, in the existing inventory statement, which was signed by the representatives of the FDM (at the direction of Shmyhal), the Ministry of Fuel and Energy of Ukraine, as well as the management of the newly created enterprise Dobropillyavugillya-Vydobutok, fictitious goods were entered, which were actually exported to the mines of DTEK "Pavlogradvugillia" . According to the trade unions of Dobropilliauvugillya State Enterprise, the shortage of goods and services amounts to more than UAH 300 million.
