The investigation has so far not handed over any suspicion to persons who may be involved in the death of servicemen of the 128th separate mountain assault brigade in the Zaporizhzhia region.
"In this criminal proceeding, a complex of investigative (search) and procedural actions is being carried out with the aim of ensuring a full, comprehensive, effective and impartial investigation of the circumstances of the commission of criminal offenses and the completion of the pre-trial investigation in a reasonable time," the document says.
The investigation continues on the facts of treason and negligent attitude to military service. Journalists learned from the materials of the court register that SBI investigators seized a mobile phone and two laptops from the commander of the reactive artillery battery.
"As the investigation notes, spy software was installed on this equipment, which could have leaked information about the location of servicemen of the 128th Separate Mountain Assault Brigade. Some of them were involved in the awarding ceremony for the Day of Missile Troops and Artillery, when Russia launched a targeted missile attack on Ukrainian defenders," the article states.
The deputy commander of the reconnaissance company for morale and psychological support, who was part of the circle of military personnel who knew about the awarding of servicemen of the 128th separate mountain assault brigade on November 3, 2023, was also questioned.
According to him, in mid-October 2023, he encountered problems logging into the Signal messenger account, where the data about the awarded persons was later published. The witness stated that he changed the SIM card and joined the Signal group with a new number. He also noted that the account with his previous number had changed its nickname to “ivan75hz”, although he had not done so. The court has now seized the phone of this military man.
In addition, the commander of the 128th Separate Mountain Assault Brigade, Colonel Dmytro Lysyuk, was issued a report on a military administrative offense under Part 2 of Article 172-16 of the Code of Administrative Offenses (“Military Authority Inaction”). The serviceman was reproached for the fact that during November 3-7, 2023, he did not inform (neither verbally nor in writing) about the death of the military to the head of the Zaporizhia specialized prosecutor's office in the field of defense. In this way, the brigade commander violated the disciplinary statute of the Armed Forces of Ukraine and the internal instructions of the Ministry of Defense, the investigation claims, the journalists added.
This case fell apart in court because the prosecutor's office did not collect enough evidence (did not collect explanations from Colonel Lysyuk, did not identify witnesses). We will remind, on November 4, a tragedy occurred in the 128th brigade - the occupiers attacked Ukrainian servicemen in one of the front-line villages of the Zaporizhia region during the line-up for the presentation of awards on the occasion of the Day of Missile Troops and Artillery.
Three-day mourning for the fallen soldiers has been announced in Zakarpattia Oblast. The 128th Brigade confirmed the death of 19 soldiers due to a Russian missile strike. The SDF reported that the Ministry of Defense is investigating the actions of the officials who organized the formation of the soldiers of the 128th brigade.
