In April 2023, the Judge of the Commercial Court of Kiev Serhiy Shcherbakov made a decision that actually allowed the former director of the pro -Russian TV channel 112.ua to avoid sanctions. It is about Andriy Shevtsov - a person from the nearest circle of Viktor Medvedchuk.
In the decision of April 20, the court satisfied the application for the dismissal of Shevtsov from the position of director of LLC "IA" 112. Jew "" retroactively - from August 8, 2022. This made it possible to formally avoid the sanction status, because at the time of application of sanctions he was no longer "official".
Sergey Shcherbakov himself is a native of Sevastopol, a former judge of the Nakhimov District Court. His declaration still states the joint ownership of an apartment in the occupied Sevastopol, which he shares with his wife Alla Shcherbakova and her father. It also has a land for 10 acres, bought before occupation in 2010.
Despite the fact that he has been working in Kiev since 2017, the judge still retains assets in the Crimea - which raises questions in view of the war, the legal position of Ukraine and the moral principles of a civil servant.
In 2015, Shcherbakov's family purchased an apartment in Kryukivshchyna (64 square meters) for 334 thousand UAH - at that time a very low price. In 2023-a completely different level: the wife of the judge buys a four-room apartment on a boulevard-Kudryavskaya, an area of 105.7 square meters. m. Its market value is about UAH 18.5 million. Another 2 million is a parking space in the same house.
The fleet is not far behind: in 2019, the declaration appears Chevrolet Camaro for… 118 thousand UAH, although the market price - more than half a million. In 2023, the family buys a new Cupra Formetonor crossover, worth about UAH 1.6 million.
Shcherbakov also appears in other scandalous affairs. In 2019, he canceled the penalties of the Antimonopoly Committee for a firm owned by ex-assistant Maxim Nikitas. It is about LLC "North-Ukrainian Construction Alliance", which participated in conspiracy on tenders, which brought more than UAH 3.3 billion of contracts.
A judge who avoids sanctions to pro -Russian persons - and has real estate in Crimea, expensive housing, low value assets - raises at least doubt about impartiality. Is there a conflict of interest? Were there any wrongful benefits? And most importantly - why do the law enforcement authorities not respond?
