The head of the "Servant of the People" faction, Davyd Arakhamiya, submitted a draft law for consideration, which became the occasion for a wide-ranging discussion. According to this draft law, the government will be able to confiscate 100% of a company's shares if a sanctioned person is among its shareholders. This initiative was intended not only to protect owners who are not under sanctions, but also to make it impossible for sanctioned persons to evade responsibility.
However, after a lively public reaction, the draft law was withdrawn for further revision before it was included in the agenda for voting. Business representatives expressed many comments on the proposed regulations.
An explanatory note to Bill 11195 noted that many sanctioned individuals hold assets through foreign jurisdictions where such sanctions do not apply. According to the initiators, the proposed changes were supposed to make it impossible to hide assets and protect the rights of third parties.
However, critics of the bill pointed to the risks associated with the discretionary powers it would give the government. The anti-corruption committee noted that the lack of clear criteria may lead to selective application of the law.
Representatives of all factions opposed the draft law in its current form. In particular, Yaroslav Zheleznyak from the "Golos" faction pointed out the need to revise the text in order to avoid the potential risks that the businessmen indicated in the statement.
Representatives of the political faction "European Solidarity" expressed the most decisive position. Oleksiy Goncharenko stated the need to cancel consideration of this draft law. "This draft law is aimed at destroying the institution of property rights and promotes ordinary raiding! According to its provisions, if among the owners of the enterprise there is a person to whom the NSDC has applied economic sanctions, then the state is given the right to confiscate all 100% of the enterprise's shares. This applies not only to the shares of the sanctioned entity, but to all shares," said the People's Deputy.
The appeal to "Batkivshchyna" was unsuccessful, but in the comments on Facebook, the representative of the faction, Oleksiy Kucherenko, also expressed a strong opposition. "This is a real disaster! We are categorically against it," he wrote.
Even the "Servant of the People" faction did not express support for such a bill. Andriy Motovylovets, the first deputy head of the faction, claimed that "this law will not be in the hall." Thus, the document never made it to the parliament for consideration.
Perhaps, if it were not for the active reaction of business and the public, the draft law could be considered in this form. In any case, it was already included in the agenda and withdrawn from consideration, perhaps at the last moment.
