Gladkovsky (Svinarchuk) case: Indictment sent to court

The case against the former First Deputy Secretary of the National Security and Defense Council (NSDC) Serhiy Gladkovsky, also known as Svinarchuk, has been sent to court. Prosecutors of the Specialized Anti-Corruption Prosecutor's Office (SAP) based on the materials of the pre-trial investigation by detectives of the National Anti-Corruption Bureau (NABU) have sent to court an indictment accusing the former First Deputy Secretary of the NSDC, former Deputy Minister of Defense and Director of a Department of the Ministry of Defense of causing losses to the state in the total amount of 17.44 million hryvnias.

During the pre-trial investigation, it was established that Gladkovsky (Svinarchuk) used the power and official position granted to him contrary to the interests of the service in order to obtain illegal benefits from a structure in which he and his close associates have a share of ownership, namely, PJSC "Automobile Company "Bogdan Motors" (Poroshenko's company).

Thus, the specified person ensured non-exclusion from the state defense order, despite non-compliance with the conditions stipulated by the government, and the subsequent purchase of MAZ 6317 (Bogdan 6317) off-road trucks at the expense of the state budget from the subsidiary "Auto Assembly Plant No. 2", which is part of PJSC "Automobile Company "Bogdan Motors".

At the same time, the Deputy Minister of Defense and the Director of the Department of Military-Technical Policy for the Development of Armaments and Military Equipment of the Ministry of Defense organized the purchase of the aforementioned trucks within the framework of the state defense order. Despite the fact that these vehicles did not meet the government's requirements, the company still received the order.

In addition, it turned out that the contract between the Ministry of Defense and the manufacturing company provided for a partial prepayment, as well as fixing the price of the goods. However, contrary to this condition, the price for the goods was increased and the officials of the Ministry of Defense department responsible for the procurement agreed to it, having previously agreed on this issue with the Deputy Minister of Defense.

As a result, the firm was illegally overpaid 17.44 million hryvnias. In October 2019, the former First Deputy Secretary of the National Security and Defense Council, Gladkovsky-Svinarchuk, was notified of the suspicion. In April 2020, the former Deputy Minister of Defense and the Director of the Department of the Ministry of Defense were notified. The specified persons were indicted for committing a crime under Part 2 of Article 364 of the Criminal Code of Ukraine.

Since June 2020, the defense has been familiarizing itself with the materials of the pre-trial investigation.

As of today, the pre-trial investigation in the case has been completed. The indictment has been sent to the High Anti-Corruption Court for consideration on the merits.
