The Court of Appeal overturned the verdict by the former head of the Brovarsky District State Administration Pavel Maybozhenko, who was found guilty of an accident in a state of alcoholic intoxication, which was affected by four people. This was reported by the Office of the Prosecutor General.
According to the report, the Kyiv Court of Appeal granted the appeal of the prosecutor and canceled the sentence issued by the Brovarsky City Court. The case is sent for a new trial to the court of first instance.
"Due to the fundamental position of juvenile prosecutors of the Kyiv Regional Prosecutor's Office, the Kyiv Court of Appeal overturned the sentence of the Brovarsky City Court and awarded a new trial," the official message said.
We will remind that earlier the Brovarsky court appointed Pavel Maybozhenko a fine of 34 thousand hryvnias and deprived the right to drive vehicles for three years. This decision has caused widespread public resonance because of the softness of punishment, given the gravity of the crime.
In August 2021, Maibozhenko, driving drunk, committed four pedestrians. Underage was affected by the accident. The driver tried to avoid responsibility, referring to service status and other circumstances.
The Prosecutor General's office has repeatedly emphasized the need for fair punishment for officials who violate the law, especially if it concerns the safety of citizens. Following the appeal, which was filed by juvenile prosecutors, the court found the need to re -consider the case, taking into account all the circumstances.
Currently, the case will be considered again in the court of first instance, where prosecutors will seek a severe punishment corresponding to the crime.
