Another blow to the odious capital building. The Volyn District Administrative Court found an illegal permission to build a H2O residential complex, a large -scale project of Stolitsa Group, which was planned in the security area in Osokorki. Under the high -rise buildings they wanted to give a site that should be a green zone behind the master plan.
The court's decision was a response to the long -term struggle of the Osokorki Ecopark NGO. Back in 2018, activists filed a lawsuit, pointing to the violation: lack of environmental impact assessment, ignoring town planning documentation, construction on land with a different purpose.
The court agreed: the permission to build, issued on April 27, 2018, DABI to the companies "Contactbudservice" and "will be evolved" - illegal. In fact, it casts doubt on the validity of any work on the object.
However, the developer is not going to retreat. Stolitsa Group, which is associated with Vadim Molchanov, has already announced the appeal. The company argues that the decision was made "with procedural violations" - without calling their representatives, without a court hearing and allegedly against the position of the Supreme Court. Despite the canceled permission, construction on the site is ongoing.
The H2O project has a confusing story. It arose after the transfer of assets of the Bankrupt Bank of Arcade Stolitsa Group - together with two other objects: Patriotic and Eureka. For the completion of Stolitsa unfinished, she made a memorandum with the Kyiv City State Administration, which provided for partial funding for new construction - in particular H2O LCD.
Activists fear that under the guise of solving the problem of Arcade depositors, developers are actually pushing illegal buildings in recreational areas.
The court verdict is not final - the appeal ahead. But for a community that has been fighting against the sealing of the building in Osokorki, it is already a victory.
