The Supreme Anti -Corruption Court has chosen a precautionary measure in the form of a pledge of UAH 2 million for a retired judge, the former head of the district administrative court of Kyiv (2006–2010) Oleg Bakun. He is suspected of being built up by a businessman before providing an unlawful benefit to a current judge in order to obtain the necessary court decision.
15,000 dollars for “necessary” decision
According to the investigation, Bachun suggested the entrepreneur to help resolve the issue with the intersection of the state border and return the passports seized by filing a claim to the administrative court. In his turn, he guaranteed a favorable court decision - for monetary fee.
The cost of "forensic aid" was estimated at $ 15,000. Of these, 10 thousand are for the decision, and another 5 thousand - for its immediate execution. The Bachun had an influence on the current judge who had to hear the case.
Released, renewed through the ECtHR, released again
This is no longer the first scandal in Oleg Babun's career. In 2010, he was released for breach of the judge's oath. However, in 2017, he was able to reinstate the position of the European Court of Human Rights in the Kulikov and Others Against Ukraine, which declared the release of Bakun illegal.
However, on April 1, 2024, the High Council of Justice was released again - this time at its own resignation statement.
Qualification and investigation
The retirement judge's actions were qualified immediately under several articles of the Criminal Code of Ukraine:

Part 3 of Art. 369 (proposal or providing an undue benefit to an employee),

Part 1 of Art. 14 and Part 4 of Art. 369 (preparation for crime).
The investigation is carried out by NABU under the procedural guidance of the Specialized Anti -Corruption Prosecutor's Office.
In the case of proving guilty, the Babunov threatens long -term imprisonment and confiscation of property. His participation in attempts to influence the judicial system after a high -profile renewal through the ECtHR raises additional questions about the effectiveness of the purification of the judiciary in Ukraine.
