CCC and wanted persons: who is wanted and who is not subject to the law

During the period of martial law in Ukraine, territorial recruitment and social support centers (TCS) have the right to put citizens who do not fulfill their military duties on the wanted list. This applies to conscripts, military conscripts, and reservists who did not appear within the specified deadlines to undergo a medical examination, clarify their credentials, or receive a summons.

At the same time, active military personnel are not subject to such a search. They are registered in their military units, not in the CCC, so they cannot be considered as evading mobilization measures. This is reported by the portal “Yuristy.UA”.

In practice, there are cases of misunderstandings. One of the servicemen turned to lawyers after the CCC notification group informed him of his alleged wanted status during a document check. Information about this, according to the center's employees, was available in the "Reserve+" application. Lawyer Yuriy Ayvazyan explained that the "Reserve+" application can indeed record an administrative wanted status, but it applies only to conscripts, military conscripts, and reservists who have violated the registration rules. If a person is already an active serviceman, then no such actions of the CCC apply to him. Another lawyer, Vyacheslav Kirda, added that sometimes such notifications can be the result of technical errors or excessive initiative of CCC employees. In any case, even if an active serviceman is notified of his "wanted status," this has no legal force, and such a person cannot be held accountable.

According to current legislation, the wanted list of the TCC applies exclusively to persons who are registered in the territorial centers, but do not fulfill their duties. This category includes: conscripts who evade the draft; those liable for military service who have not clarified their data or have not appeared when called; reservists who have not arrived for service. Active military personnel serving in the Armed Forces of Ukraine do not fall under this category and cannot be declared wanted by the TCC. Lawyers advise that if you receive a wanted list, contact the territorial recruiting center for clarification or for legal assistance.

It was previously reported that Ukraine plans to introduce an electronic Military ID for each serviceman. This digital identifier will allow information to be exchanged between state registries without disclosing personal data.
