In Ukraine, there are new clarifications regarding the medical examination of conscripts who have a deferment from mobilization. As noted by lawyer Nataliya Opolska, conscripts who applied to the territorial recruitment and social support centers (TCC) with an application for a deferment will not be sent for a medical examination until a decision is made by the commission.
What does the new legislation provide?
According to Cabinet Resolution No. 560 dated May 16, 2024, conscripts who applied to the TCC with an application for a deferment are not subject to being sent for a medical examination to determine their fitness for military service until the commission makes the appropriate decision. However, there are some important caveats:
- In case of refusal to grant a deferment , the conscript will be sent for a medical examination to determine his suitability for service.
- The period of validity of the deferral is also important - if it has not ended, then the person is also not subject to a medical examination, except in situations where he enters into a contract for military service.
Nataliya Opolska emphasizes that the VLK certificate is valid for one year, and even if it is postponed, the conscript must ensure that this period does not expire, especially during martial law.
