The Cabinet of Ministers of Ukraine has approved a draft law that clearly defines who has the right to a deferral from mobilization during martial law. The draft has already been prepared for submission to the Verkhovna Rada. Its provisions primarily concern students, scientists, and teachers.
This was announced by the government representative in parliament, Taras Melnychuk, and People's Deputy Oleksiy Honcharenko.
Among the key provisions is the specification of categories of persons who are not subject to mobilization, provided that they meet the criteria.
Who can get a deferral?
According to the bill, the following will receive a deferral:

students of vocational schools and college students who entered no later than a year before reaching the age limit for mobilization;

university students who are pursuing a certain level of higher education for the first time;
-
doctoral students, interns and resident doctors - provided that they are studying at the appropriate level for the first time;
-
scientific, scientific-pedagogical and pedagogical workers who work at a rate of at least 0.75 in institutions of all levels of education - from schools to scientific institutions;
-
teachers of extracurricular education institutions (for example, group leaders), if they were officially employed before the beginning of 2025.
Another important condition for students is that they must not have reached the age of 25 at the time of entering the educational institution, and their studies must be full-time or dual.
Who will lose the right to a deferral?
The following will not be able to receive a deferral:

men aged 25 and over who already have a higher education and are pursuing a second education at the same or lower level;
-
persons who began their studies abroad after February 24, 2022.
The new bill aims to close legal loopholes and prevent abuses of fictitious training to avoid mobilization. If approved by parliament, the document could be an important step in regulating the issues of reservation and deferment during martial law.
