Chernihiv court closes case against driver who patrol officers tried to "turn over" to CCC

The Desnyanskyi District Court of Chernihiv has closed administrative proceedings against local resident Gennady R., who was accused by patrol police of driving under the influence of drugs. The court found that there were no grounds for such accusations, and the actions of the law enforcement officers themselves raise serious questions.

According to the case materials, on April 9, 2025, patrol officers stopped a Volkswagen Passat due to an unlit turn on a roundabout. The driver provided documents and explained that he worked at a critical infrastructure enterprise and had a "reservation" from mobilization, which was then in the process of being extended. Despite this, the police officers offered him a ride with them to the Trade Center.

After the man refused, the patrol officers declared that he was in a state of drug intoxication, drew up a report under Article 130 of the Code of Administrative Offenses and nevertheless took him to the CCC, where Gennady spent four days until his booking was confirmed.

In court, the company's management confirmed that the driver undergoes a daily medical examination and has never abused alcohol or drugs. The video from the chest cameras also did not record any signs of intoxication or conflict behavior. Instead, it turned out that the police issued a referral for a medical examination "retroactively."

The court concluded that the requirement to undergo an inspection was unfounded, and the driver's refusal could not have negative consequences. On July 22, the proceedings were closed "due to the absence of elements of an administrative offense." On August 2, the decision entered into force.
