The Supreme Anti-Corruption Court has decided to close the proceedings in the “Rotterdam+” case against former members of the National Commission for the Regulation of Energy and Utilities of Ukraine Oleksandr Formagei and Dmytro Kovalenko. This was reported by Transparency International Ukraine and the Anti-Corruption Action Center.
Both officials were accused of official negligence (Part 2 of Article 367 of the Criminal Code of Ukraine) during the vote on the commission's resolution, which was in effect until July 1, 2019. However, the five-year statute of limitations had expired, so the court terminated the proceedings. As specified in the Code of Civil Procedure, civil claims for compensation for damages will not be considered after that.
