The appellate court left unchanged the decision of the court of first instance on the confiscation of unfounded assets of the former head of one of the district councils of the Rivne region. The total value of the property subject to recovery to the state revenue exceeds 5.6 million hryvnias. The decision entered into force from the moment of its proclamation.
The decision was based on the results of monitoring the official's lifestyle, as well as materials from law enforcement agencies. During the inspection, it was established that the former official acquired five land plots with a total area of about four hectares in the Kyiv region.
An analysis of income and expenses showed that the official did not have legal financial resources to purchase such property. The cost of the land plots significantly exceeded the declared and confirmed income, which was the basis for recognizing the assets as unfounded.
The decision of the Court of Appeal finally confirmed the legality of the confiscation. According to current legislation, persons in respect of whom a court decision has entered into force declaring assets unfounded and their recovery into state revenue are subject to dismissal from their positions in accordance with the procedure established by law.
