The Holosiivskyi District Court of Kyiv declared illegal the actions of the police during a raid on one of the capital's gay clubs, which took place on August 1. The case under consideration concerned citizen Serhiy S., who was detained and charged with "malicious disobedience" and "petty hooliganism."
The raid on the Dark Room club was carried out on the Day of Mourning for those killed in the missile strike. The reason for the police visit was an anonymous call about loud music. In the case file, the police claimed that Serhiy S. behaved aggressively, swore and resisted. However, the man himself, like the other detainees, stated that he did not violate public order and did not know about the Day of Mourning.
In addition, Serhiy S. claimed that during the arrest, the police took his iPhone 15 Pro without recording it in the protocols. The phone was never returned to him.
But the most scandalous details became known at the court hearing. The detainees said that at the police station they were humiliated, beaten and forced to give “necessary” testimonies all night. The police took offensive photos and took the detainees to the Central Criminal Investigation Center to clarify the data.
Having examined the case materials, the court found no evidence of Serhiy S.'s unlawful behavior. In particular, the protocols contained no specific information about his resistance or hooliganism.
As a result, the court not only closed the case against Serhiy S., but also ordered the police to return the iPhone that was taken from him. Moreover, the court issued a separate ruling in which it acknowledged a number of illegal actions by the police, including:
- application of unauthorized methods to detainees,
- violation of the rules for working with anonymous appeals,
- Detention of citizens for a period significantly exceeding the three hours established by law.
