The Hadyatsky District Court of Poltava Oblast found a 46-year-old resident of Poltava Oblast guilty of deliberate evasion of mobilization. The man was sentenced to three years in prison, but was released from serving the sentence with a probationary period of one year. The verdict was handed down in case No. 526/4127/24.
According to the case materials, on August 24, 2024, the man received a summons and was supposed to arrive at the territorial recruitment center on August 26. However, he did not appear at the summons. In court, he pleaded guilty, explaining that the day before receiving the summons, he was hospitalized due to poisoning, where he was handed the document. Due to poor health and the belief that he was unfit for service due to health problems, he never appeared at the TCC.
As it turned out during the consideration of the case, the man had heart and vision defects since childhood, which were grounds for exemption from military service. In January 2024, the medical commission discovered a disease that required treatment, and he was recognized as fit only in March of the same year. However, he did not enter service until the second call-up.
In February 2025, the defendant suffered a cold injury - he frostbitten the toes of both feet, which led to the amputation of both lower limbs. Currently, the man is unable to move independently and requires assistance. His wife, who suffered a stroke in 2023, is also unable to work, and the couple is raising two minor children.
The court found the man guilty under Article 336 of the Criminal Code of Ukraine (evasion of military service), but, taking into account the circumstances of the case, postponed the execution of the sentence with a probationary period.
