The Galera hotel and restaurant complex, located on the banks of the Dnieper River in Kyiv, is to be demolished according to the decision of the Northern Appeal Economic Court. The owner must dismantle the illegally erected building, and the 0.5 hectare plot, with a market value of 3.2 million hryvnias, will be returned to the ownership of the territorial community of the capital.
As reported by the Kyiv City Prosecutor's Office, the facility was illegally constructed within the Dnieper coastal protection zone at 35 Naberezhno-Korchuvatska Street. The land plot belongs to the water fund lands, which are under special state protection. Development in such territories is expressly prohibited by law.
During the investigation, it turned out that the owner first built the facility without permission, and then transferred it to the authorized capital of the company. The basis for registering the ownership right was a decision of the district court, which was later canceled.
In 2018, it was on the basis of this illegal development that the owner received a lease of 0.5 hectares of water fund land. Thus, the scheme of obtaining land through violation of building and land regulations was effectively legalized.
The appeals court's decision became an important precedent that confirmed the need for strict compliance with legislation on the protection of coastal zones and water fund lands.
At the time of the decision, the facility continued to operate as a commercial establishment, which, according to the prosecutor's office, violated environmental and land legislation.
