The Lviv District Administrative Court has overturned the decision of the district military medical commission (VLK) on the fitness for military service of a man suffering from chronic musculoskeletal diseases. The court ordered doctors to conduct a new medical examination taking into account the plaintiff's diagnosis.
According to the court decision published in January 2025, a resident of Lviv region, who was diagnosed with chronic musculoskeletal diseases back in 2012, applied to the court. The man had repeatedly undergone military service examinations since the beginning of the full-scale war, where he was first declared unfit for service, and later - limitedly fit. However, in July 2023, the district military service examination determined him fit for military service, without taking into account his chronic diseases, which was the reason for the appeal to the court.
"The defendant unlawfully failed to take into account the documents on the plaintiff's medical history, and therefore made an unlawful decision on fitness for military service," Judge Natalia Gren noted in her decision.
The court granted the claim, overturning the decision of the Military Medical Commission regarding the recognition of the plaintiff as fit for service, and ordered a new medical examination, taking into account all medical conclusions. It is important to note that the court's decision can still be appealed.
This case has drawn attention to the importance of proper and comprehensive medical examination of military personnel, especially in cases of chronic diseases. Authorities and medical authorities must ensure proper monitoring of the health of military personnel in order to avoid erroneous decisions that could affect people's lives and health.
