Former deputy head of the customs offenses department of Odessa Customs, Oksana Chernyavska, has become a defendant in several cases. In addition to a high-profile investigation into illicit enrichment, she tried to appeal an inspection for false declarations, but lost the appeal.
This became known from the decision of the Odessa Administrative Court of Appeal in case No. 815/5299/17, 368.media reports
Back in October 2017, Chernyavska sued the National Police Department for Economic Protection and its regional department, demanding that the verification of her electronic declaration be declared illegal. The case involved an untimely notification to the NACP regarding the sale of a Mercedes-Benz ML-350: the car was re-registered on October 5, 2016, but the declaration was updated only in June 2017.
Chernyavska was charged with violating Article 366-1 of the Criminal Code of Ukraine, and she herself was able to achieve a positive decision in the first instance - the court recognized the police actions as unlawful. However, the appeals court overturned this decision and refused to satisfy the claim.
The judges found that the law enforcement officers acted within the law, and the re-inspection was initiated due to identified shortcomings in the previous conclusion. It was also noted that Chernyavska did not specify which actions she was appealing, which complicated the consideration of the case.
At the same time, the case materials indicate that two officials who made mistakes during the initial inspection were held disciplinary accountable.
It was previously reported that Chernyavska is also involved in a case of illicit enrichment. According to the investigation, she owns assets that do not correspond to her official income.
