The Pension Fund explained how pensions are assigned to prosecutors

Pension provision for prosecutors in Ukraine is regulated by special legislation, which determines the right to receive pensions for long service, disability, as well as pensions in connection with the loss of the breadwinner for members of their families. The main regulatory legal act regulating these issues is the Law of Ukraine No. 1697.

This is stated in the materials of the PFU.

Law 1697 provides for the right to grant prosecutors retirement and disability pensions, and to their family members - survivor's pensions.

Long-service pension

Prosecutors are entitled to a pension for years of service, regardless of age, provided that, on the date of application, they have at least:

  • by September 30, 2011 – 20 years, including at least 10 years of work experience as a prosecutor;
  • from October 1, 2011 to September 30, 2012 – 20 years and 6 months, including at least 10 years and 6 months of work experience as a prosecutor;
  • from October 1, 2012 to September 30, 2013 – 21 years, including at least 11 years of work experience as a prosecutor;
  • from October 1, 2013 to September 30, 2014 – 21 years and 6 months, including at least 11 years and 6 months of work experience as a prosecutor;
  • from October 1, 2014 to September 30, 2015 – 22 years, including at least 12 years of work experience as a prosecutor;
  • from October 1, 2015 to September 30, 2016 – 22 years and 6 months, including at least 12 years and 6 months of work experience as a prosecutor;
  • from October 1, 2016 to September 30, 2017 – 23 years, including at least 13 years of work experience as a prosecutor;
  • October 1, 2017 to September 30, 2018 – 23 years 6 months, including at least 13 years 6 months of work experience as a prosecutor;
  • from October 1, 2018 to September 30, 2019 – 24 years, including at least 14 years of work experience as a prosecutor;
  • from October 1, 2019 to September 30, 2020 – 24 years 6 months, including at least 14 years 6 months of work experience as a prosecutor;
  • from October 1, 2020 and later – 25 years, including at least 15 years of work experience as a prosecutor.

A pension for prosecutors is assigned in the amount of 60 percent of their monthly (current) salary, which includes all types of remuneration from which a single contribution to mandatory state social insurance was paid, and until January 1, 2011 - insurance contributions to mandatory state pension insurance, received before the month of applying for a pension.

The amount of payments (except for official salaries, seniority bonuses) included in earnings for calculating the pension is determined at the choice of the person who applied for a pension, for any 60 calendar months of such work in a row before applying for a pension, regardless of the presence of breaks during this period in this work.

The average monthly amount of the specified payments for 60 calendar months is determined by dividing the total amount of such payments by 60. The adjustment of the specified payments is carried out using the coefficient of the general increase in the size of the official salary and allowances to it. The official salary, allowances for seniority during the appointment of a pension are taken into account in the amounts for the last position held by the prosecutor, established at the time of the emergence of the right to recalculate the seniority pension.

Employees who do not have the above-mentioned years of service, provided they have the necessary length of service in prosecutor positions, as well as the insurance period required for the assignment of an old-age pension in the minimum amount provided for in paragraph one of part one of Article 28 of the Law of Ukraine “On Compulsory State Pension Insurance”, upon reaching 57 years for men and five years less than the retirement age established by Article 26 of the Law of Ukraine “On Compulsory State Pension Insurance” for women, shall be assigned a pension in an amount proportional to the number of full years of service in prosecutor positions, calculated at 60 percent of the monthly salary for the relevant length of service.

The length of service entitling to a retirement pension includes the time spent in the prosecutorial positions specified in Article 15 of Law 1697:

  • interns, assistants and senior assistants to prosecutors;
  • investigators, judges;
  • in positions of command staff of internal affairs bodies, tax police, penal enforcement service, officer staff of the Armed Forces of Ukraine, the Security Service of Ukraine, other military formations formed in accordance with the legislation of Ukraine, in positions of civil servants held by persons with higher legal education;
  • in scientific and educational institutions of the Prosecutor General's Office of Ukraine, to employees who, before the entry into force of this law, were awarded class ranks (for employees of the military prosecutor's office - the corresponding military ranks), including the time of scientific and teaching work in other scientific and educational institutions, if they had a scientific degree or academic title;
  • in administrative and teaching positions, positions of researchers at the National Academy of the Prosecutor's Office of Ukraine;
  • in elected positions in state bodies, in positions in other organizations, if employees who, before the entry into force of this Law, were assigned class ranks (for employees of the military prosecutor's office - the corresponding military ranks) were sent there and then returned to the prosecutor's office;
  • military service, half of the term of study at full-time higher legal educational institutions or at law faculties of full-time higher educational institutions;
  • leave to care for a child until the child reaches the age of three, if such leave was granted.

The right to a pension for long service shall be granted to persons who, immediately before applying for the appointment of such a pension, worked in the bodies of the prosecutor's office or in scientific and educational institutions of the Prosecutor General's Office of Ukraine, as well as persons dismissed from prosecutorial positions in the bodies of the prosecutor's office due to health reasons, in connection with the liquidation or reorganization of the prosecutor's office in which the person holds a position, or in connection with a reduction in the number of prosecutors, in connection with their election to elective positions in state authorities or local self-government bodies. War veterans who have the necessary length of service for the appointment of a pension for long service shall be granted such a pension regardless of whether they worked in the bodies of the prosecutor's office before applying for the appointment of a pension.

Disability pension

Prosecutors recognized as persons with disabilities of group I or II are granted a disability pension if they have at least 10 years of work experience in the prosecutor's office.

As a reminder, during May and June, some pensioners may receive pension supplements. This is provided for by a special program from the UN, which has been operating in Ukraine since August 2023.
