The Qualification and Disciplinary Commission of Prosecutors did not dismiss Roman Muzychuk, the head of the Rivne Regional Prosecutor's Office, who was involved in a traffic accident in June and refused to undergo a breathalyzer test. The commission found him guilty of a disciplinary offense, but limited itself to a one-year ban on promotion, citing "sincere remorse" and a positive reference.
According to the court's decision, the incident occurred in June 2025 in the village of Mlyniv, Rivne region. While turning, the car driven by Muzychuk did not give way to another car moving oncoming, and a collision occurred. When patrol officers arrived, they recorded signs of intoxication: the smell of alcohol, facial redness, impaired coordination, and agitated behavior.
However, the prosecutor refused to undergo the examination, stating that he “didn’t trust the device.” Later, he also failed the test at the hospital, explaining this by distrust of local doctors. According to the police, Muzychuk tried to avoid the examination by showing his prosecutor’s ID and offering to “draw up a report on his son.”
At the commission meeting, Muzychuk admitted that he had caused the accident, but explained his condition by medical procedures: he allegedly received an injection for back pain that day, and the alcohol swabs under the plaster could have created the smell of alcohol. Also, according to him, after the airbag hit, he suffered a dissection of the bridge of his nose and dizziness, which could have looked like signs of intoxication.
He later went to the Rivne Regional Mental Health Center on his own, where no signs of intoxication were found.
The CDCP recognized the fact of a disciplinary offense, but took into account that Muzychuk had been working in the prosecutor's office since 1999, had no previous convictions, compensated the victim for damages, and repented.
" Taking into account sincere remorse, positive characterisation and voluntary compensation for damage, the commission applies disciplinary action to the prosecutor in the form of a ban on transfer to a higher position for one year ," the decision states.
Thus, the prosecutor who refused to take an alcohol test after a traffic accident remained in office.
