The Prosecutor General's Office is trying to seize 14.5 hectares of land from the Institute of Fisheries: the plot was planned to be developed by Molchanova's company

The Prosecutor General's Office of Ukraine is seeking to return to the state a land plot with an area of ​​14.5 hectares on Obukhivska Street in the Sviatoshynskyi district of the capital. According to law enforcement officers, the land of the Institute of Fisheries of the NAAS of Ukraine was used for other purposes: instead of creating ponds for growing fish, preparations for residential development began on it. The company "Accept Logistics Group", associated with businesswoman Vladyslav Molchanova, was supposed to implement this project. The KV .

On December 4, 2025, the Kyiv Commercial Court will hold a preparatory hearing in case No. 910/12587/25. The Prosecutor General's Office demands to cancel the registration of two plots with a total area of ​​over 230 hectares, terminate the institute's right of permanent use of a plot of 14.5 hectares and return it to state ownership. This concerns the lands of the Nyvka research farm, which were transferred to the institute in 1999 for scientific activities and the operation of fish ponds.

Law enforcement officers emphasize that during the initial registration in 2001, the category of land for water management purposes was not included in the cadastre, and in 2009 the institute concluded an agreement with Accept Logistics Group, allowing the company to prepare the territory for a future cottage town. According to the prosecutor's office, the ponds on the site were filled in, the territory was leveled, and then the land was illegally classified as "land for residential and public development", although the authorized body did not make a decision to change its purpose.

In October, the prosecutor's office filed a lawsuit and has already secured its claim: the court temporarily banned any construction and preparatory work on the 14.5-hectare plot and the transfer of both plots to third parties. This is intended to prevent re-registration of the land or the start of active construction until the process is completed.

Lawyer and human rights activist Oleksandr Dyadyuk emphasizes that the institute had no right to independently conclude such agreements, since the Kyiv City State Administration is the administrator of state lands in Kyiv, and now the Kyiv City State Administrative Agency. He noted that if the prosecutor's office wins, the next step will be to appeal the development agreement. Dyadyuk tried to join the case as a third party from the charitable organization "KEKTS", but judge Serhiy Turchyn refused. The lawyer claims that "they want to conduct the case quietly," but adds that the prosecutor's office has a chance of success.

He argues his doubts about the consideration of the case in the first instance with previous decisions of the same judge, in particular in the case on the return of lands near Lake Vyrlytsia to the Kyiv community. At that time, the first instance court also refused the prosecutor's office, but the decision was overturned in the appellate and cassation instances.

The history of this land plot dates back over 20 years. In 2006, the institute entered into a development participation agreement with the company “Nove Misto”, which later transferred its rights to “Accept Logistics Group”. The company received permits for preparatory and construction work back in 2010–2012, but the project was never implemented. In 2016, the National Police opened criminal proceedings due to possible illegal development of water fund lands, but in 2021 the case was closed “due to the absence of elements of a crime”. The courts of first and appellate instances then concluded that the construction did not contradict the intended purpose of the site.

Despite this, the prosecutor's office's new lawsuit is based on the fact that the land category was changed illegally, and the institute actually deprived the state of its water resources, destroying hydraulic structures, ponds, and violating the terms of land use. Law enforcement officers also note that the water bodies could not be privatized or leased.

Accept Logistics Group LLC is linked to the development groups BT INVEST and Stolitsa Group, which control significant assets in the real estate and retail sectors. Vladyslav Molchanova, a key figure in the group, was previously a co-owner of the company Nove Misto, the first investor in the development on Obukhivska. Her business has repeatedly appeared in scandalous land stories, in particular in the case of 18 hectares of the Stolichny market, where NABU and SAPO reported suspicions of possible illegal privatization of land.

Similar conflicts arise regarding the lands of other scientific institutions, in particular the National Academy of Sciences of Ukraine, whose plots in the Holosiivskyi district are also being offered for development to private companies, which causes legal disputes and community protests. Dyadyuk emphasizes that state scientific institutions have effectively turned into land management operators, and investment agreements are concluded in a non-transparent manner, often without competitions and without the approval of the Cabinet of Ministers.

The fate of the 14.5-hectare plot on Obukhivska Street now depends on the court. If the prosecutor's office proves the illegality of the change in purpose and the excess of authority by the institute, the land may be returned to the state.
