Military personnel can decide for themselves who will receive assistance in the event of their death

The Ministry of Justice of Ukraine has explained how military personnel can pre-determine the persons who will receive a lump sum payment in the event of their death. Such a document can be drawn up in any form, independently indicating the future recipients and distributing the shares in percentages between them.

According to the Ministry of Justice, a military person has the right to designate any persons, regardless of family ties. However, the law guarantees that certain categories of relatives will receive their share of assistance in any case. These include:
– minor, underage and adult children who are unable to work;
– a widow or widower who is unable to work;
– parents who are unable to work.

These individuals receive 50% of the share that would belong to them by law, even if the military officer specified other recipients in the order.

To issue a document, you need to draw up a written order in any form, having it certified by a notary or by the commander of the military unit. The original document is stored in the serviceman's personal file at the territorial recruitment and social support center (TCK and SP), and a copy remains with the serviceman. Information about the content of the order is confidential.

If a serviceman does not leave such a document, a lump-sum cash benefit in the event of his death will be distributed in accordance with Article 16-1 of the Law of Ukraine "On Social and Legal Protection of Servicemen and Members of Their Families.".
