General mobilization is underway in Ukraine, and with it, control over compliance with military registration rules is being strengthened. The Verkhovna Rada has adopted draft law No. 12093, which introduces a number of changes to the mechanism for holding liable military conscripts who violate mobilization legislation accountable.
The new law provides for several key innovations. First, a 50% discount on fines is being introduced for those who voluntarily agree to the violation and pay the fine within 10 days. This means that with a standard fine of 17,000 hryvnias, evaders will be able to get away with half the amount – 8,500 hryvnias. The fine will be payable through the “Rezerv+” application or via “Ukrposhta”.
Secondly, the law introduces automatic closure of cases for those who voluntarily enter military service. If a conscript already has an open case for violating military registration, but then joins the ranks of the Armed Forces of Ukraine, the fines are canceled and the proceedings are closed.
In addition, the mechanism for imposing fines is being significantly simplified. Now they can be issued without drawing up a protocol - the fact of returning the summons with the mark "refusal to receive" or "not served" is enough. Fines can also now be considered at the place of stay of the conscript or at the place of his detention. This means that after being forcibly delivered to the CCC, evaders can immediately receive a fine.
Finally, in the event of failure to pay the fine within 30 days, the law allows for enforcement, including the seizure of the violator's bank accounts.
Lawyers believe that the adopted changes will not only strengthen discipline among those liable for military service, but also make the mechanism for controlling mobilization more stringent. In fact, evading military registration will now be even more expensive, and avoiding responsibility will become much more difficult.
