The Podilskyi District Prosecutor's Office of Kyiv has filed a lawsuit with the court to return to municipal ownership a non-residential building located in a building at 39 Nyzhniy Val Street in the Podilskyi district of the capital.
According to the prosecutor's office, the specified premises were removed from the ownership of the territorial community based on a court decision made back in 2010. Later, this decision was canceled, since during its consideration by the court, unreliable information was provided, as well as forged documents were used.
Despite the annulment of the court decision, the ownership of the real estate remained registered with the legal entity. This, according to the prosecutor's office, creates grounds for reclaiming the property in the interests of the city community.
In order to restore the violated rights of the territorial community, the prosecutor filed a lawsuit with the Commercial Court of Kyiv. The court has already opened proceedings in the case and scheduled a preparatory court hearing.
The prosecutor's office notes that the return of illegally alienated municipal property is one of the priority areas of work, as it concerns the preservation of community property assets and the prevention of their loss as a result of questionable court decisions of past years.
