Alakor City LLC, which is the sole contender for managing one of the largest trading and entertainment centers of Kyiv-Hulli shopping center, has significant financial obligations to the state. According to information from the Unified State Register of Judgments, the company has owed more than 66 million hryvnias of taxes , which is why the State Tax Service requires their recovery.
Alakor City has problems with the tax due to a considerable amount of debt. The tax service in Kiev claims that this company has reduced its VAT tax liabilities for the amount of more than UAH 28 million, and therefore it was also charged in the amount of more UAH).
The courts had previously supported Alakor City, but on December 17, 2024 in Case No. 320/8946/23, the Supreme Court of Ukraine partially canceled the decision of the previous instance and sent the case for re -examination to the court of first instance. This means that the tax problems of Alakor City LLC have not yet been resolved, and now the court of first instance should again consider the company's objection to the requirements of the tax service. However, this time, given the findings of the Supreme Court of Ukraine, which disagreed with the cancellation of tax notices.
It is ironic that the Gulliver shopping mall has been transferred to the ARMA Department as arrested material evidence in criminal proceedings on tax evasion.
The chairman of the Agency for Search and Management of Assets (ARMA), Elena Duma, stated that she has established rigid criteria for future managers who should meet high standards and guarantee stable revenues to the state budget from the management of arrested assets.
However, against the background of information about the tax requirements for Alakor City for tens of millions of hryvnias, the question arises: does such a company meet the declared criteria and high requirements declared to Ms. Duma? Is this company capable of providing its own debts to the state, to provide effective management of the Gulliver shopping mall and a stable receipt of funds to the state treasury?
Given the financial problems of Alakor City, there are reasonable fears about the company's ability to effectively manage a huge asset in the center of the capital. Is the state not at risk of losing potential profit if the management is transferred to a structure that could not cope with its own tax obligations? Will such a company try and in this case to evade payments to the budget by assigning income from management?
