In Transcarpathia, the Mizhhirsky District Court adopted a sentence of a man who was sentenced to 3 years and 6 months imprisonment for evasion. As stated in the sentence, in December 2023 the man received a summons, but wrote a statement of refusal to service in the Armed Forces of Ukraine, explaining his decision by the fear of the war and the fact that his brother is already serving.
During the court hearing, the defendant pleaded guilty, but drew attention to the personal circumstances that contributed to his decision. However, the court, taking into account the preliminary dishonorable conviction of the man in the case of the spread of pornography, made a more severe punishment.
Pursuant to Article 336 of the Criminal Code of Ukraine, evasion of mobilization during the war is punishable by imprisonment. This decision emphasizes the seriousness of the approach to mobilization issues during the war and serves as a warning for other potential evaluates.
This case has become another example of how the justice system responds to evasion of mobilization in martial law. It should also be noted that the Cabinet of Ministers of Ukraine recently adopted a resolution on the order of delay from conscription, which caused concern among the educational community.
