The Supreme Anti-Corruption Court (SAC) has granted the claim of the Ministry of Justice of Ukraine to confiscate the assets of the Belarusian state-owned enterprise “Belaruskaliy”, which is under sanctions. This concerns over 250 million hryvnias in monetary assets, over 70 thousand tons of potassium chloride, 1,545 wagons, as well as corporate rights - 48% in the Ukrainian LLC “Agrorozkvit”.
This was reported by the press service of the Ministry of Justice.
According to the court decision, the following passed into the state ownership of Ukraine:
-
over 70,000 tons of potassium chloride;
-
cash funds totaling over 250 million hryvnias;
-
1,545 freight cars;
-
48% of the corporate rights of Agrorozkvit LLC, an enterprise registered in Ukraine.
At the same time, as the Ministry of Justice emphasized, the company lost the right to any compensation for lost property.
Belaruskaly is one of the largest producers of potash fertilizers in the world and one of the budget-generating enterprises of Belarus. It is under the full control of the regime of Alexander Lukashenko.
According to the Ministry of Justice, the company:
-
cooperates with Russian military-industrial enterprises;
-
supplies products to the structures of the so-called “L/DPR”;
-
involved in the logistical support of the illegal deportation of Ukrainian children to the territory of Belarus.
It was these actions that became the basis for the application of sanctions and a subsequent lawsuit for the confiscation of assets.
The seizure of assets of the strategic Belarusian enterprise comes amid increasing economic and political pressure on the allies of the Russian Federation, which, according to Kyiv's official position, are participating in aggression against Ukraine. In 2022, Belaruskaly was included in the sanctions lists of Ukraine, the EU, the US and Canada.
As the Ministry of Justice emphasized, the decision of the Supreme Court of Justice is "an important step in holding accountable those foreign companies that directly or indirectly support aggression against Ukraine.".
