The Ukrainian court made an extremely strict decision to revoke the driver's license of a citizen of the country for an extremely long period of time - more than 56 years. The decision was made on June 11 by the Goshchansky district court of the Rivne region within the framework of case number 557/662/24, reports Sudovo-yuridychna Gazeta.
It is noted that on April 15, 2024, a citizen was driving a Ford EcoSport crossover and was stopped by the police. Signs of drug intoxication were found in him (narrowed pupils that did not respond to light, tremors of the fingers, unnatural paleness of the face), but he refused medical examination, which was recorded on video.
The driver was issued a report under Art. 130 of the Code of Ukraine on administrative offenses (driving a vehicle while intoxicated). It turned out that this is far from the first such violation. Not only that, the Ukrainian had already been deprived of his driver's license for drunken driving, so a protocol was also drawn up under Art. 126 of the Criminal Procedure Code (Driving a vehicle by a person who does not have the appropriate documents).
Having studied the materials of the case, the court came to the conclusion that the citizen's actions constitute offenses provided for in Part 5 of Article 126 and Part 3 of Article 130 of the Labor Code of Ukraine. Since these are not his first offenses, the defendant was sentenced to administrative arrest for 15 days and again deprived of his right to drive for 10 years.
However, the court did not stop there. The fact is that Part 3 of Art. 30 of the Code of Criminal Procedure stipulates that if a person has been deprived of a driver's license and before the expiration of the ban on driving a vehicle has committed another offense for which the deprivation of rights is also provided for, then the unserved part of the previous penalty is added to the term of the new penalty. That is, the punishments actually add up.
In this case, the driver was previously deprived of the right to drive a vehicle for drunk driving or driving without a license already five times:
- the resolution of the Korolovsky District Court of Zhytomyr dated 30.11.2023 - a fine of UAH 51,000 with deprivation of the right to drive for 10 years for Part 5 of Article 126, Part 3 of Article 130 of the Labor Code of Ukraine
- resolution of the Korolovsky District Court of Zhytomyr dated 26.12.2023 - a fine of UAH 51,000 with deprivation of the right to drive for 10 years for Part 5 of Article 126, Part 3 of Article 130 of the Labor Code of Ukraine
- resolution of the Radomyshl district court of the Zhytomyr region dated March 19, 2024 - a fine of UAH 51,000 with deprivation of the right to drive for 10 years under part 5 of article 126, part 3 of article 130 of the Labor Code of Ukraine
- resolution of the Kyiv-Svyatoshinsky district court of the Kyiv region dated March 25, 2024 - a fine of UAH 51,000 with deprivation of the right to drive for 10 years under Part 3 of Art. 130 of the Labor Code of Ukraine.
- resolution of the Bohun District Court of Zhytomyr dated March 29, 2024 - a fine of UAH 51,000 with disqualification from driving for 10 years for Part 5 of Article 126, Part 3 of Article 130 of the Labor Code of Ukraine.
According to each of the resolutions, the unserved part of the penalty exceeds 9 years, since the driver repeatedly got behind the wheel, having already been deprived of his license. When applying an administrative penalty to the driver, the court summed them up and added them to the new penalty. That is why it turned out that the driver was deprived of the right to drive vehicles for 56 years, 6 months and 14 days.
