Undeclared property and dubious income: what the judges of the Busky court accuse

Judge Ihor Kos of the Busky District Court of Lviv Oblast, who is participating in the competition for the position of a judge of the Court of Appeal, received a negative assessment from the Public Integrity Council. The reason was doubts about the transparency of his property status, possible concealment of real estate in the declaration, as well as questions about the quality and timing of court decisions.

The key comments concern the 62 square meter apartment in Lviv, which the judge allegedly uses free of charge. Formally, the apartment is registered in the name of his sister, Halyna Senyk. At the same time, members of the Public Integrity Council believe that the appearance of free use may conceal the actual purchase of the apartment by the judge for his own needs.

According to the inspection materials, the judge did not provide convincing evidence regarding the sources of origin of the funds for which the apartment was purchased. In addition, the price of housing specified in the contract appears to be at least half the market value of similar apartments in Lviv at that time, which is confirmed by information from specialized real estate resources.

According to the explanations provided, in December 2016, the judge's sister signed a contract for the purchase of a future apartment worth 444.1 thousand hryvnias. The price, she said, was reduced by 10% on condition of full payment within five days after signing the contract. It was also noted that at the time of the agreement, the developer did not yet have a registered building permit, which allegedly led to additional risks and a decrease in value.

However, the Public Integrity Council was critical of these arguments. Over 13 years, the judge's sister's official income was only 190 thousand hryvnias, while her husband declared 539.2 thousand hryvnias of income. These amounts, in the council's opinion, were not enough to purchase such property, even taking into account the discount.

During the interview, Ihor Kos explained that the funds for the purchase of the apartment came from several sources: a gift from his parents in the amount of $50,000 in 2014, about $10,000 given for the wedding in 2016, as well as savings from his sister and her husband in the amount of $30,000. However, these explanations did not convince the GRD, since the parents' official income also did not allow for such expensive financial gifts.

Additional questions are raised by the fact that Judge Kos lived in this apartment for seven years, while his sister did not use the apartment. Before that, from 2013 to 2017, the judge and his family lived free of charge in an apartment belonging to his wife's employee and friend.

The Public Integrity Council paid special attention to the professional activities of the judge. In the period from 2010 to 2025, Ihor Kos considered 1,116 cases of administrative liability under Article 130 of the Code of Administrative Offenses. During the analysis, at least 10 cases were identified that require additional explanations due to violation of reasonable terms of consideration of cases. As a result of the delay in the processes, some drivers avoided liability due to the expiration of the statute of limitations.

Taken together, these circumstances, according to the conclusion of the Public Integrity Council, indicate the presence of signs of dishonesty and call into question the compliance of Judge Ihor Kos with the criteria necessary to work in the appellate court.
