Ukrainian students returning from foreign universities and transferring to domestic universities can count on a deferral from mobilization. However, as lawyers warn, this right does not always guarantee automatic protection - the decision may depend on the territorial recruitment center.
Lawyer Yaroslav Turchyn wrote about this in a column on the “Yuristy.UA” portal.
According to current legislation, students of Ukrainian higher education institutions have the right to a deferment from mobilization. This also applies to those who return from abroad — for example, from Poland — and officially transfer to a Ukrainian university.
“If everything is done correctly, then, of course, you will have a deferral, starting at 25 years old,” said Yaroslav Turchyn.
The lawyer emphasized that even if the formalities are followed, the territorial procurement center (TCC) has the right not to recognize the postponement. “Unfortunately, such cases have already occurred — and formally the TCC is right in this situation,” he explained.
Also, a mandatory condition for the student is to be removed from the conscript register and placed on the military service register.
