The Ministry of Defense of Ukraine supported the new draft law, which provides for the creation of private military companies (PMC) in Ukraine. This document, which has already been registered on the government portal, opens a new stage in the formation of the security and defense market in the country.
The conclusion of the Ministry of Defense states that the proposed version of the draft law is inconsistent with the Constitution of Ukraine, the laws of Ukraine "On the Defense of Ukraine" and "On Intelligence". It also contradicts international agreements and the recommendations of the Montreux document, which discloses the functioning of private military companies during armed conflict. It is noted that Ukraine is one of the 17 states that took part in its preparation.
The ministry emphasizes that it is necessary to create a regulatory and legal framework for the implementation of military consulting activities with the involvement of international best practices. The Ministry of Defense proposes to finalize the project by involving experts of the Ministry of Defense to work on the draft law.
The author of the draft law is "servant of the people" Serhii Hryvko. The document defines the legal status and organizational and legal principles of the activities of international defense companies that are established in Ukraine and participate in the implementation of defense measures.
It is noted that such companies will also provide defense services outside of Ukraine. The draft Law proposes to create the State Service of Ukraine for International Defense Companies, which will deal with regulation and management in the field of activities of international defense companies. It will report to the Main Directorate of Intelligence of the Ministry of Defense of Ukraine.
The new state body will monitor the activities of private companies, register agreements on defense services, and also account for the weapons and equipment on their balance sheet.
