The higher anti-corruption court supported the unification of the cases of oligarch Oleg Bakhmatyuk, accused of providing an illegal benefit to the former head of the State Fiscal Service Roman Nasirov, with the case against Nasirov himself and his assistant.
The court made such a decision on June 11.
The anti-corruption court assigned Bakhmatyuk's case to be heard separately from Nasirov's case. The SAP prosecutor and the oligarch's lawyer submitted a request to transfer the case to another panel of judges, which is hearing the case of the ex-head of the Federal Security Service, to consider the issue of unification.

"To transfer the materials of the court case in the criminal proceedings regarding the accusation (of Bakhmatyuk) of committing a criminal offense, provided for in part 4 of Article 369 of the Criminal Code, to the panel of judges of the Supreme Administrative Court to resolve the issue of merging with the court proceedings in the criminal proceedings (regarding Nasirov)," the decision reads. .
It will be recalled that NABU and SAP have suspected the ex-head of the Federal Tax Service, Roman Nasirov, of receiving more than UAH 722 million in illegal benefits. Also, oligarch Oleg Bakhmatyuk was informed in absentia about the suspicion of providing this benefit.
The investigation established that the head of the Federal Tax Service (2015-2016) received an illegal benefit of $5.5 million for providing reimbursement of over UAH 540 million to agricultural holding companies in August 2015 and over EUR 21 million for reimbursement of almost UAH 2.7 billion of VAT during February From 2015 to August 2016, Nasirov received "Service Fees", which amounted to about 20% of the amount of VAT reimbursed, to the account of a foreign company controlled by him, as well as a company controlled by his father-in-law and adviser through another foreign company. The sender of the funds was a non-resident company controlled by the owner of the agricultural holding Bakhmatyuk.
Part of the illegal profit was formed directly from the funds of the budget VAT refund and converted into foreign currency. NABU and SAP have evidence that the head of the Federal Tax Service prioritized payments for VAT refunds to agricultural holding companies, instead, did not include information about the amounts declared for budget refunds by other economic entities, which led to lawsuits by these companies and their collection from the state budget of at least 2 million UAH penalty.
