The Supreme Anti-Corruption Court found two defendants guilty in the case of large-scale losses to the state-owned enterprise "Center for Certification and Expertise of Seeds and Planting Material." They are the former director of the state-owned enterprise and the head of two private companies, due to whose actions the state lost more than UAH 13.4 million.
The investigation established that an official of a state enterprise and a director of private structures acted in collusion. By abusing their official position and facilitating such actions, they organized a scheme that caused significant financial losses to the state enterprise. The case materials indicate that the decisions and contracts adopted by the structures controlled by the managers were exclusively unprofitable for the state, but instead created benefits for related commercial companies.
The court found the former head of the state enterprise guilty of Part 2 of Article 28 and Part 2 of Article 364 of the Criminal Code of Ukraine. He was sentenced to 4 years in prison and banned from holding managerial positions in the public sector for three years. The court also ordered him to pay a fine of UAH 13,600.
The director of private companies was found guilty under Part 5 of Article 27, Part 2 of Article 28 and Part 2 of Article 364 of the Criminal Code of Ukraine. He received 3 years and 10 months of imprisonment, as well as a ban on holding managerial positions in the field of business for a period of almost three years. In addition, the court imposed a fine of UAH 12,750 on him.
The Supreme Court of Justice also fully satisfied the civil claim of the state-owned enterprise and ruled to collect jointly and severally from both convicts UAH 13,407,841 as compensation for the damages caused.
The verdict can be appealed within 30 days to the Appeals Chamber of the Supreme Court of Justice.
