Ukraine has new clarifications regarding the medical examination of conscripts who have a deferment from mobilization. As noted by lawyer Natalia Opolska, conscripts who have applied to territorial recruitment and social support centers (TCS) with an application for a deferment will not be sent for a medical examination until a decision is made by the commission.
What does the new legislation provide for?
According to the Cabinet of Ministers Resolution No. 560 of May 16, 2024, military conscripts who have applied to the CCC for a deferment are not subject to a medical examination to determine their fitness for military service until the commission makes a relevant decision. However, there are several important caveats:
- In the event of a refusal to grant a deferment , the conscript will be sent for a medical examination to determine his fitness for service.
- The term of the deferral is also important - if it has not expired, the person is also not subject to a medical examination, except in situations where he enters into a contract for military service.
Natalia Opolska emphasizes that the VLK certificate is valid for one year, and even with a postponement, the conscript must ensure that this period does not expire, especially during martial law.
