What conscripts need to know about fines

Lawyer Roman Kichko explained in detail the procedure for imposing fines on conscripts for administrative offenses related to mobilization. According to him, this process is somewhat reminiscent of a court case, but has specific features stipulated by law.

Kichko noted that a fine can only be imposed by the head of the territorial procurement center (TCC), and this takes place in the premises of the TCC. “The head of the TCC in such a situation acts as a kind of judge. He considers the case materials, analyzes the evidence and adopts a resolution on bringing to administrative responsibility,” the lawyer explained in an interview with Ukrainian Radio.

Who has the right to impose a fine?

Kichko emphasized that imposing fines for administrative violations related to mobilization is not within the powers of police officers or the court. This right is exclusively reserved for the head of the CCC. The procedure is regulated by the Code of Ukraine on Administrative Offenses, which also defines the requirements for drawing up a protocol and a resolution on a fine.

“A person has the right to appeal the imposition of a fine, so the general rules regarding administrative offenses remain in force,” the lawyer added.

Deferral of mobilization: key points

Against the backdrop of a full-scale war in Ukraine, mobilization continues, and some categories of citizens have the right to deferment. Assistant to the Head of the Ternopil Region CCC Roman Grunda explained that the presence of the right to deferment and supporting documents does not guarantee its automatic granting. Deferment from conscription is granted depending on family circumstances, health status, education or professional activity.
