Mobilization continues in Ukraine, and the issue of deferments from military service remains extremely relevant. In 2024, some categories of citizens may lose their deferments, which is causing concern among those liable for military service. Lawyers explain who exactly risks being left without protection from conscription.
Lawyer Tetyana Savchenko, in a comment to UNIAN, noted that at the moment there are no official statements that someone may be deprived of a deferral. Although there have been previous proposals to cancel deferrals for students and persons with disabilities, such changes have not yet been implemented. According to Article 23 of the Law “On Mobilization Training and Mobilization”, persons with disabilities have the right to receive a deferral on general grounds.
However, there are categories for which deferment from mobilization is not available. In particular, deferment is not granted to:
- Students studying part-time or evening classes, as well as those who are pursuing a second higher education.
- Parents with many children who have alimony debts.
- Military conscripts who care for a husband or wife with a disability of group 3, if there are other able-bodied persons in the family.
- Single parents (fathers), if the child's mother is not deprived of parental rights.
- Employees of enterprises and organizations of the Ministry of Defense.
- Conscripts who, after a repeated military medical commission (MMC), were found fit for service.
There are also several reasons why a deferral may be canceled. These include:
- Expiration of the deferral period.
- If the deferral was for the care of a minor child, but the child has reached the age of 18 (however, if the child has a disability, the deferral remains in effect).
- Death of the person being cared for.
- Dismissal of a booked employee.
- Failure to comply with the conditions under which the deferral was granted.
- Providing false information to obtain a deferral.
It is emphasized that even if a conscript is entitled to a deferment, but has not properly filed it or has not extended it, he may be served with a summons. This information is important for everyone subject to mobilization, as proper paperwork can help avoid being drafted into military service.
