How to properly appeal a decision of the MSEK: step-by-step instructions

The center for assessing the functional state of a person is engaged in checking the validity of the decisions of expert teams and considering complaints about these decisions. It aims to ensure the fairness and transparency of the evaluation process, which is important for people who need medical expertise from different regions of Ukraine.

How to file a complaint?

A complaint can be submitted both electronically and in paper form. To submit an electronic complaint, you must contact the attending physician who referred the person for evaluation. The doctor will issue a complaint in electronic form and send it to the Center through the electronic system. A paper complaint can be sent by mail.

Deadlines and requirements for a complaint

The complaint must be filed within 40 calendar days after receiving an extract from the decision that is being appealed. It is important that the complaint contains:

  • first name of the complainant,
  • Address of residence or stay,
  • Contact details (phone, email),
  • Requirements and justification,
  • The date of filing the complaint.

Missing the deadline for filing a complaint

If the deadline for submitting a complaint is missed for valid reasons (for example, business trip or temporary incapacity), you can submit a request to renew the deadline. This request is submitted to the Evaluation Center with confirmation of good reasons (copies of documents). The center considers the request within five working days.

Consideration of the complaint

Consideration of a complaint can take place in various forms: face-to-face, absentee or with the help of telemedicine. The expert team evaluates the documents, listens to the complainant's explanation and, if necessary, conducts a re-evaluation based on medical examinations.

If the complainant refuses the medical examination or does not appear for it without valid reasons, the expert team can cancel the contested decision.

Assessment Center solutions are possible

After considering the complaint, the Assessment Center can make one of the following decisions:

  1. Confirm the contested decision.
  2. Cancel the contested decision.
  3. Make a new decision based on re-evaluation.

Each decision is signed by all members of the expert team.
