What changes can be expected in Ukraine after the introduction of the register of conscripts

Territorial recruitment centers now have the ability to use most of Ukraine's state electronic registers to obtain information about citizens directly from their workplaces. This innovation will simplify the process of collecting data on conscripts, eliminating the need to organize raids in cities to determine their possible whereabouts.

On the one hand, this approach will facilitate the work of the military and ensure peace in the lives of citizens. On the other hand, there is a serious threat of using the obtained personal information for illegal purposes. Lawyer Stanislav Liflyanchyk examined this situation and shared his thoughts on the possible consequences for Ukrainians liable for military service, identifying both the positive and negative sides of the innovations.

At the same time, the Verkhovna Rada of Ukraine adopted a draft law entitled “On Amendments to Certain Laws of Ukraine on Improving the Procedure for Processing and Using Data in State Registries for Military Registration and Obtaining the Status of a War Veteran During Martial Law” (No. 10062). This draft law provides for reforms aimed at improving the processes of processing and using data in state registries, in particular, for military registration and determining the status of a war veteran during martial law.

People will no longer be caught on the streets thanks to innovations in the military registration system. The lawyer believes that the register of those liable for military service will be created on the basis of the “Oberig” system. Currently, this system is filled in manually, when people independently enter archives. In addition, information about those caught on the streets also enters the “Oberig” system. However, not all military personnel on the street have access to this system, which creates difficulties for territorial recruitment centers (TCK).

Problems arise when a person needs to obtain the status of “Participant in hostilities”, make changes to documentation, or report their place of residence. According to lawyer Stanislav Liflyanchyk, now the CCC will have access to other registers, such as tax, property rights, migration service, etc. This will allow them to receive up-to-date data on the status of citizens, taking into account their place of registration and actual residence.

This approach will allow the CCC to effectively use logic to locate citizens, including determining their place of work, salary, and current location. According to the lawyer, this eliminates the need to conduct operations “Busik”, “Restran”, “Sportzal” and others that involve catching citizens on the streets.

In addition, CCCs now have the right to collect and store personal data, an area that was previously a conflict of law. They can now legally collect data from other registries, which simplifies the process and eliminates the need to submit requests to different authorities.

The process of obtaining the status of a Participant of Combat Operations (UBD) in Ukraine can be significantly simplified thanks to innovations in the system. There were often problems with determining the terms and procedure for assigning this status, in particular due to long-awaited refusals or misunderstandings on the part of military organizations. The main problem was the paper-based nature of the information flow, which delayed the decision-making process.

Lawyer Stanislav Liflyanchyk believes that the reform will consist in creating an automated database that will include information about combatants. This will cover all stages of their service, from the moment of mobilization to participation in combat. Such a system will avoid unnecessary delays and misunderstandings.

The new procedure will provide for the possibility of applying for UBD status through the conscript's office. A person will be able to simply submit an application and receive a response about their status without the need to personally visit the military service. This will simplify the procedure for soldiers and avoid unnecessary misunderstandings and delays that often occurred in the paper format of document processing.

According to the expert, these innovations will have a positive impact on the military accounting system. Now the Territorial Recruitment Centers will be able to work with registers quickly, obtaining the necessary information without unnecessary difficulties for citizens.

Personal data may become a subject of danger due to the introduction of innovations in the military registration system. The lawyer identifies potential risks associated with access to electronic registers of military conscripts. Cases of misuse of data have already been recorded, such as the sale of PrivatBank and Invitro databases, or unauthorized access to the Action.

Stanislav Liflyanchyk gives examples of security breaches that can occur due to improper access to registers. In particular, in the real estate sector, when hackers can interfere with the BTI archive and the electronic register of property rights, gaining access to electronic documents and re-registration of property rights. The expert is concerned that Territorial Procurement Centers (TPCs) can become a place for the unsafe use of personal data.

The lawyer expresses indignation that the CCC employs people who do not undergo sufficient vetting. The possibility of information leakage from this register becomes a serious risk, since service in the CCC is compulsory, and people who get there can commit various unworthy acts. The lawyer calls for the introduction of limited access to personal data, placing responsibility on those who have access, up to and including criminal liability.

At the same time, the expert recognizes the importance of forming a robust registry in Ukraine, but emphasizes the potential threats from hacker attacks. The protection of this registry is identified as a critically important aspect of restoring and preserving the personal data of military personnel.

The Ministry of Defense believes that the adoption of the new bill will contribute to the intensification of the digital development of the Ukrainian army, making it more mobile and effective both on the battlefield and in the rear.

Representatives of the Ministry of Defense claim that the implementation of this bill will facilitate the operational collection, processing, and use of military data, as well as allow services and processes for military personnel to be transferred to a convenient digital format.

It is noted that this will provide an opportunity to strengthen cyber defense and allow the Ministry of Defense's IT systems to be hosted in the military clouds of NATO member countries. This will free up resources, protecting national data centers from potential cyber attacks, and will also contribute to expanding the Defense Forces' access to intelligence allies.

Improving the register of conscripts and those liable for military service is another key component of the bill. Important changes include improving the interaction between registers and the use of military registration data. The possibility of creating and using a digital military registration document (certificate) is also introduced.

In addition, new registers of military personnel of the Armed Forces of Ukraine and the State Special Transport Service will be created to provide online services to military personnel. In particular, an electronic services portal for military personnel and those liable for military service will be developed, where an online procedure for obtaining the status of a Participant of Combat Operations (UBD) will be available.
