What changes can be expected in Ukraine after the introduction of the register of conscripts

Territorial procurement centers now have the opportunity to use most of the state electronic registers of Ukraine to obtain information about citizens directly from their workplaces. This innovation will simplify the process of collecting data on conscripts, avoiding the need to organize raids on cities to determine their possible whereabouts.

On the one hand, this approach will facilitate the work of the military and ensure peace in the lives of citizens. On the other hand, there is a serious threat of using the obtained personal information for illegal purposes. Lawyer Stanislav Liflyanchyk reviewed this situation and shared his thoughts on the possible consequences for conscripted Ukrainians, identifying both positive and negative aspects of the innovations.

At the same time, the Verkhovna Rada of Ukraine adopted a draft law entitled "On Amendments to Certain Laws of Ukraine on Improving the Procedure for Processing and Using Data in State Registers for Military Registration and Acquiring War Veteran Status During Martial Law" (No. 10062). This draft law provides for reforms aimed at improving the processes of processing and using data in state registries, in particular, for military registration and determining the status of a war veteran during martial law.

People will no longer be caught on the streets thanks to innovations in the military accounting system. The lawyer believes that the register of conscripts will be created on the basis of the "Oberig" system. Currently, this system is manually populated when people enter archives themselves. In addition, information about those who are caught on the streets also enters the "Oberig" system. However, not all military personnel on the street have access to this system, which creates difficulties for territorial procurement centers (TCC).

Problems arise when a person needs to obtain the status of "Participant in hostilities", make changes in documentation or inform about the place of residence. According to lawyer Stanislav Liflyanchyk, now TCC will have access to other registers, such as tax, property rights, migration service, etc. This will allow them to receive up-to-date data on the status of citizens, taking into account their place of registration and actual residence.

This approach will allow the TCC to effectively use logic to locate citizens, in particular to determine their place of work, salary received, and actual location. According to the lawyer, this cancels the need to carry out operations "Busik", "Restran", "Sportzal" and others, which include catching citizens on the streets.

In addition, TCCs now have the right to collect and store personal data, an area previously a legal conflict. They can now legally collect data from other registries, which simplifies the process and eliminates the need to submit requests to different authorities.

The process of obtaining the status of a Participant in combat operations (UBD) in Ukraine can be significantly simplified thanks to innovations in the system. There were often problems with determining the terms and procedure for assigning this status, in particular due to long-awaited refusals or misunderstandings on the part of military organizations. The main problem was the paper-based nature of information circulation, which delayed the decision-making process.

Lawyer Stanislav Liflyanchyk believes that the reform will consist in the creation of an automated database that will include information about the participants in the hostilities. This will cover all stages of their service, from the moment of mobilization to participation in combat operations. Such a system will avoid unnecessary delays and misunderstandings.

The new procedure will provide for the possibility of submitting an application for the status of UBD through the conscript's office. A person will be able to simply submit an application and receive an answer about his status without the need for a personal visit to the military service. This will simplify the procedure for soldiers and avoid unnecessary misunderstandings and delays that often occurred in the paper format of document processing.

According to the expert, these innovations will create a positive impact on the military accounting system. Now Territorial procurement centers will be able to quickly work with registers, receiving the necessary information without unnecessary difficulties for citizens.

Personal data may become a subject of danger due to the introduction of innovations in the military accounting system. The lawyer identifies potential risks associated with access to electronic registers of conscripts. There have already been recorded cases of data misuse, such as the sale of Privatbank and Invitro databases, or unauthorized access to Diya.

Stanislav Liflyanchyk gives examples of security breaches that can occur as a result of improper access to registries. In particular, in the field of real estate, when hackers can intervene in the archive of BTI and the electronic register of property rights, gaining access to electronic documents and re-registration of property rights. The expert is concerned that the Territorial Completion Centers (TCCs) may become a place of dangerous use of personal data.

The lawyer expresses indignation at the fact that TCC employs people who do not pass sufficient checks. The possibility of leaking information from this registry becomes a serious risk, since service in the TCC is compulsory, and people who get there can commit various nefarious acts. The lawyer calls for the introduction of limited access to personal data, placing responsibility on those who have access, up to criminal liability.

At the same time, the expert recognizes the importance of forming a powerful registry in Ukraine, but emphasizes potential threats from hacker attacks. Protection of this register is defined as a critically important aspect of recovery and preservation of personal data of servicemen.

The Ministry of Defense believes that the adoption of the new draft law will contribute to the activation of the digital development of the Ukrainian army, making it more mobile and effective both on the battlefield and in the rear.

Representatives of the Ministry of Defense claim that the implementation of this draft law will facilitate the operational collection, processing and use of military data, as well as allow the transfer of services and processes for servicemen into a convenient digital format.

It is noted that this will provide an opportunity to strengthen cyber defense and allow IT systems of the Ministry of Defense to be placed in military cloud storage facilities of NATO member countries. This will free up resources protecting national data centers from potential cyber attacks, and will also help increase the Defense Force's access to intelligence on allies.

Improving the register of conscripts and conscripts is another key component of the draft law. Important changes involve improving the interaction between registers and the use of military registration data. The possibility of creating and using a digital military accounting document (certificate) is also introduced.

In addition, new registers of servicemen of the Armed Forces of Ukraine and the State Service of Special Transport will be created to provide online services to servicemen. In particular, a portal of electronic services will be developed for military personnel and conscripts, where the online procedure for obtaining the status of a Participant in Combat Actions (UBD) will be available.
