Deputy head of the NBU Rozhkova lost her property due to debts to the Deposit Guarantee Fund

The first deputy head of the National Bank of Ukraine, Kateryna Rozhkova, got into an unpleasant situation when bailiffs began selling her property due to debts to the Deposit Guarantee Fund of Individuals (FGVFO). On December 30, 2024, her parking space at the street address was sold. Volynska, 10 in Kyiv in the amount of 502.3 thousand. UAH This sale became part of the execution of the court decision in the framework of enforcement proceedings 72392283, and only a few weeks later, on January 6, 2025, Rozhkova herself reported this fact in a report to the National Agency for the Prevention of Corruption (NACP).

The case of Platinum Bank and Rozhkova's debts

To understand the reasons why Kateryna Rozhkova found herself in such a situation, it is necessary to go back to the events of 2017, when the National Bank of Ukraine revoked the license of Platinum Bank, where Rozhkova held the position of acting head of the board After that, the Deposit Guarantee Fund was forced to put Platinum into liquidation, and depositors who lost their funds began to demand compensation through the courts.

Fulfillment of these requirements by the FGVFO included filing a lawsuit against the bank's former management, including Kateryna Rozhkova, in June 2020. The lawsuit concerned UAH 1.48 billion, and court proceedings lasted more than three years. Kateryna Rozhkova and 10 of her colleagues from the management of Platinum Bank lost the case in March 2024, when the Commercial Court of Cassation as part of the Supreme Court recognized the demands of the Guarantee Fund as legitimate.

This verdict was fatal for Rozhkova and other defendants, because, as practice shows, in the case of losing the court, executors have the right to collect debts through the sale of property, and this is exactly what happened after the court decision.

After losing the court and making a decision to collect the debt, the bailiffs began to act. One of the first steps was the sale of Kateryna Rozhkova's real estate. On December 30, 2024, her parking space in Kyiv was sold for 502.3 thousand. UAH This became part of executive proceedings 72392283, which concerned the property belonging to the former managers of Platinum Bank.

The very process of debt collection within the framework of executive proceedings assumes that all assets of the defendant will be sold to cover the debt. Yes, even if a person only owns a share in real estate, this share can be sold. In this case, it concerned a parking space owned by Rozhkova.

Interestingly, in the declaration for 2023, Kateryna Rozhkova did not mention the sale of this property, which raised certain questions about her financial statements. In the declaration, other property is indicated, including 50% of an apartment in Kyiv, a garage, land plots and a garden house, but a parking space on the street. Volynsk did not appear.

Lawyers explain that in the case of such a debt, executors try to recover all assets for the total amount of the debt. If the debtor owns several real estate objects, each of them can be sold to cover the debt. Moreover, if the debtor tries to transfer or sell the property before the court order, it can be declared illegal, and all these actions will be canceled within the scope of the fraudulent action. Since in this case the proceedings concern UAH 1.48 billion, Rozhkova and her colleagues must part with most of their assets.

In addition to selling property, executors can also apply to the employer (in this case, the National Bank of Ukraine) to collect a part of the debtor's salary to repay the debt. This is similar to alimony withholding, where 20% of the debtor's current salary can be automatically transferred to a debt service account.

Particular attention is drawn to the fact that Rozhkova's declaration for 2023 did not indicate the sold parking space, although the state register confirms her ownership of this property. This raised the question of possible violations in the submission of information on changes in property status. Although Rozhkova herself declared changes in her property status, such as paying for education in Ukraine in the amount of 348,000 hryvnias, the fact of real estate sale was ignored.

Currently, it is not known what other assets of Rozhkova will be sold within the framework of the execution of the court decision, because she has other property that can also be levied to cover the debt. According to lawyers, the process may continue, and other real estate objects may be sold in the near future if the debts are not repaid.

Thus, the situation with the sale of Rozhkova's parking space is only the first stage of a long process of debt collection. The Deposit Guarantee Fund continues to fight to recover depositors' losses, and the issue is likely to continue for a long time.
