The Pulin District Court of Zhytomyr region appointed three years and three months of imprisonment to a local resident who has repeatedly evaded mobilization.

According to the verdict, in July 2024 the accused re-passed the Military Medical Commission, which found it suitable for service. He was handed a summons and determined the place of service - 72 separate mechanized brigade. However, on a certain day, he did not appear in the army and did not participate in the mobilization events.
In court, the man pleaded guilty and explained that he did not want to serve because of his father's health.
The defense emphasized that the man was already convicted in August 2023 for a similar episode - then the court approved an agreement on the recognition of guilt and imposed a sentence of three years of imprisonment conditionally, with a term of one and a half years. The lawyer believed that prosecuting for the second time for the same type of offense is contrary to Art. 61 of the Constitution of Ukraine and Art. 4 of the Convention on Human Rights.
However, the court explained: it is not about the same offense, but a new evasion after re -recognition of suitability and delivery of the summons. Therefore, a new sentence was added part of the previous punishment from the previous case.
The total term of imprisonment was three years and three months. The sentence can be appealed in due course.
