The Lviv District Administrative Court canceled the decision of the District Military Medical Commission (MMC) on the suitability for military service of a man suffering from chronic diseases of the musculoskeletal system. The court ordered the doctors to conduct a new medical examination taking into account the plaintiff's diagnosis.
As reported in the court decision published in January 2025, a resident of Lviv Oblast, who was diagnosed with chronic diseases of the musculoskeletal system back in 2012, appealed to the court. The man has repeatedly passed through the VLK since the beginning of the full-scale war, where he was first declared unfit for service, and later - limited fit. However, in July 2023, the district VLK determined him fit for military service, not taking into account his chronic diseases, which was the reason for the appeal to the court.
"The defendant illegally did not take into account the documents about the plaintiff's medical history, and therefore an illegal decision on fitness for military service was made," Judge Nataliya Grenj noted in her decision.
The court satisfied the lawsuit, canceling the decision of the VLK in terms of declaring the plaintiff fit for service, and ordered a new medical examination taking into account all medical conclusions. It is important to note that the court's decision can still be appealed.
This case drew attention to the importance of a correct and comprehensive medical examination of conscripts, especially in cases of chronic diseases. The authorities and medical bodies must ensure proper control over the health of military personnel in order to avoid erroneous decisions that may affect people's lives and health.
